Fachbereich 01: Rechtswissenschaft - Veranstaltungen zum Erwerb eines Fremdsprachenscheines

Este seminario permite identificar el origen de los Derechos Humanos (DD.HH.) a partir del conocimiento del contexto general de las luchas por el reconocimiento de la dignidad de los seres humanos. Así mismo, se estudia la definición, enfoque y características de los DD. HH. para comprenderlos como el resultado de un proceso sociohistórico y en permanente evolución.

El concepto de “diplomacia científica” se asienta cada vez más en la gestión de la investigación y experimenta transformaciones en la medida en que se aplica a casos específicos. Más allá de abordar las relaciones existentes entre la política científica y la política de relaciones exteriores de un país determinado, la diplomacia científica alcanzó un consenso importante como concepto cuando la Royal Academy of Science del Reino Unido y la American Association for the Advancement of Science de Estados Unidos publicaron el documento de política New Frontiers in Science Diplomacy: Navigating the Changing Balance of Power, que ha servido para enmarcar la discusión sobre el concepto. Una lectura crítica del documento, especialmente desde las experiencias del Sur Global, permite también identificar zonas grises del mismo. Es común encontrar que esta clase de conceptos globales suelen ser adaptados a las realidades de distintas regiones del mundo y sus resultados son distintos a los originalmente esperados. Lationamérica ha realizado esfuerzos de conceptualización de la diplomacia científica que se han llevado a cabo desde distintos escenarios como la Oficina Regional de Ciencias para América Latina y el Caribe de la Unesco, el Instituto Interamericano para la Investigación del Cambio Global y la Red Latinoamericana de Diplomacia Científica, entre otros.
La historia de la diplomacia científica se asocia también con la resolución de problemas de seguridad a partir de la gestión de política exterior. El ejemplo más representativo es la gestión de científicos en las embajadas durante la Segunda Guerra Mundial. Recientemente el concepto se ha extendido para abarcar actividades relacionadas con la diplomacia pública y el soft power que promueven varios países del Norte y del Sur Global.
A pesar de los avances, la elaboración conceptual parece ser bastante ascéptica. Existe la idea de que la ciencia refuerza las estrategias de política exterior de los países y ayuda a resolver los grandes desafíos globales como aquellos asociados a los Objetivos de Desarrollo Sostenible (ODS). Sin embargo, existen iniciativas que analizan más a fondo la interfase ciencia -política, y ofrecen una visión más compleja de la que se aprecia desde una postura clásica de diplomacia científica. Las categorizaciones de la Royal Academy of Science y la AAAS (diplomacia para la ciencia, ciencia para diplomacia y ciencia en la diplomacia) ayudan a tematizar esta discusión.
El Instituto CAPAZ es en sí mismo una iniciativa de diplomacia científica que refuerza la política de cooperación científica alemana en el campo de la paz. Después de 8 años de existencia, el Instituto ha acumulado experiencias importantes que aportan a la discusión del concepto de diplomacia científica para la paz. Esto se ha expresado en su reconocimiento con el premio de diplomacia científica recibido en 2020 del Ministerio de Educación y Ciencia de Alemania (BMBF) (“Raising the Profile of Education and Science Diplomacy”), y en la consolidación de la agenda de cooperación académica y científica entre Colombia y Alemania.Dentro de este contexto se hace importante revisar la pertinencia del concepto de diplomacia científica, definido a partir de la experiencia de los países del Norte Global, para contrastarlo con realidades más latinoamericanas en el campo de las ciencias sociales y los estudios de paz.
Algunas de las preguntas guía que responderá el curso son:
-    ¿Es la diplomacia científica un concepto que redefine las tradicionales actividades de cooperación científica? -    ¿Cómo ha sido utilizada para contribuir al fortalecimiento de la política exterior de los países y cómo se ha adaptado el concepto en la región de América Latina y el Caribe? -    ¿Es la diplomacia científica una herramienta robusta de cooperación o es más bien una palabra de moda (buzzword) que simplemente sirve de sombrilla a las tradicionales actividades de cooperación científica internacional? -    ¿Qué asimetrías se pueden presentar al momento de implementar estrategias de diplomacia científica entre países del Norte y del Sur global?

This course provides a comprehensive introduction to Italian private law, focusing on the fundamental elements of the legal system, including its sources, interpretative methods, and essential legal categories. Following an initial overview, key topics such as legal subjects, inheritance law, tort law, and contract law will be examined.

To enhance understanding, historical contexts and current issues will be explored, highlighting the dynamic and adaptable nature of legal institutions. For instance, the evolving nature of legal subjectivity will be discussed, from past conceptions to contemporary issues like the personification of artificial intelligence and future generations. Additionally, the shifting boundaries of tort law, moving from fault-based to strict liability forms, will be briefly examined.

Lectures will primarily be delivered in a traditional format but are designed to stimulate critical debate and discussion, ensuring active engagement with the material.

The course offers an introduction to the field of peace and conflict studies. After discussing basic concepts, the course will deal with topics including Peacebuilding; Rebel Governance; Transitional Justice and Human Rights; Gender and Interdectionality; Natural Resources and Environmental Peacebuilding as well as Education and Peace Building.

Actualmente observamos cambios profundos en la política internacional. Las consecuencias de estas reconfiguraciones repercuten en conflictos geopolíticos, cooperación internacional, relaciones comerciales, política ambiental, regímenes migratorios, crimen organizado etc. Al mismo tiempo, estos cambios en la política internacional están estrechamente vinculados con discusiones en torno a la justicia a nivel internacional y más específicamente de las relaciones Norte-Sur.
El curso inicia con un acercamiento a los enfoques teóricos de las relaciones internacionales (Neo-Realismo, Institucionalismo, Liberalismo, Constructivismo, Neo-Gramscianismo, Feminismo) que posibilitaran la comprensión y discusión informada de los procesos actuales en la política internacional. En un segundo bloque se profundizará el análisis de temas clásicos de las relaciones internacionales (conflictos violentos, cooperación al desarrollo, relaciones comerciales) y temas más recientes (política ambiental, migración, políticas culturales) de la política internacional con el fin de analizar el alcance de las reconfiguraciones globales y discutir sus implicaciones para la justicia internacional.

The seminar focuses on the multiple forms of feminist activism and knowledge production emerging in different locations of the Global South, with a particular emphasis on Latin America. It connects the political activities and discussions taking place in these contexts around women’s and LGBTQ+ rights with the fields of transitional justice and peace building, which seek to address conflicts and political violence around the world.

Students will approach various feminist currents focusing for instance on armed conflict and human rights violations, antiracist and decolonial praxis, environmental justice, and sexual and reproductive rights. The seminar also provides a conceptual background on key elements of feminist and queer theorization such as gender, intersectionality, sexual orientation/gender identity, patriarchy, structural racism, coloniality, ethnicity, care and many others.

The Law of Indian Tribes seminar provides students with a comprehensive understanding of the legal systems and principles governing Indigenous communities and Nations. Through an exploration of historical, cultural, and contemporary perspectives, students will delve into the unique legal frameworks that shape tribal communities’ lives.
The course begins by examining the historical foundations of tribal law, including the impact of colonialism and the subsequent development of tribal legal systems. Students will gain insights into the diverse cultural and spiritual traditional that underpin tribal law, fostering an appreciation for the interconnectedness between law, culture, and identity. Building upon this foundation course delves into the core principles and concepts of tribal law. Students will explore the sources of law within Indigenous communities, including tribal constitutions, written and unwritten laws. Students will analyze the role of tribal governments, tribal courts, and traditional decision-making processes in resolving disputes and maintaining governance.
The course also addresses critical issues in tribal law, such as tribal sovereignty, jurisdictional challenges, and the relationship between tribal law and federal and state legal systems. Students will examine landmark legal cases that have shaped the interpretation and application of tribal law, fostering a deeper understanding of the complexities and evolving nature of Indigenous legal systems.
Throughout the course, students will engage in comparative analyses of tribal legal systems form various Midwest tribal Nations, highlighting the diversity and richness of Indigenous legal traditions. Students will explore the unique challenges faced by Indigenous communities in areas such as land rights, natural resources management, environmental protection, and cultural preservation, as well as business, and human resources issues.

Course Description: This course is designed to give students an overview of the legal issues associated with wrongful convictions. There have been over 3,600 cases of wrongful convictions documented in the United States. This course is taught by a clinical law professor who has spent her career as a criminal defense attorney and codirects the Wisconsin Innocence Project. It is designed to provide students with an overview of the issues and case law related to wrongful convictions through readings, lectures, case studies, and classroom discussion.
Learning Outcomes: By the end of the course, students should: Be able to state the basic procedural process for litigating a wrongful conviction; Learn the factors that contribute to wrongful convictions; Debate the policy issues behind police investigation procedures; Have an understanding of the importance of evaluating facts with an open mind, viewing claims and statements of facts and law with healthy skepticism; and Be able to develop a strategy to evaluate and investigate a claim of innocence.
Your grade will be based on a final exam that will be given at the end of class.
